Funding Requirements

By placing an Order, you represent and warrant that you have sufficient funds or Digital Assets available in your External Account or wallet to complete the transaction.

The Company shall not be responsible for any failure to execute an Order resulting from insufficient funds or unavailable assets.

Fiat payments must be made from a same-name external account of which you are the beneficial owner. Reconciliation is conducted by reference to name, IBAN, and payment reference. Cryptocurrency submitted for sell orders must be sent from the self-hosted wallet designated by Bitsbazar for that order; custodial deposits are not accepted. Where submitted details or ownership proofs do not match, Bitsbazar may cancel the order and return funds to their source following the completion of applicable checks.

Clients are responsible for maintaining their own accounts and wallets with third-party service providers and for familiarising themselves with the fees and terms applicable to those providers. The Company accepts no liability for the actions of third-party service providers selected by the client.

Only payment methods approved by Bitsbazar may be used to purchase cryptocurrency. By submitting an exchange order, you represent and warrant that you are authorised to use the designated payment method and you authorise Bitsbazar or its payment processor to charge that payment method accordingly. Orders may be suspended or cancelled where a payment method is found to be invalid or unacceptable.

Third-Party Payment Providers

Transactions may involve third-party financial institutions or payment processors. Such providers may:

The Company is not responsible for any losses, fees, or delays arising from the actions or decisions of such third parties.

You acknowledge that your use of any External Account is subject to the terms and conditions of the relevant provider.

You are responsible for maintaining any External Accounts or wallets used in connection with the Services.

You acknowledge that:

The Company shall not be liable for any acts, omissions, delays, or failures of such third-party providers.

Permitted Payment Methods

Only payment methods approved and specified by the Company may be used in connection with the Services.

By submitting an Order, you represent and warrant that:

If a payment method is declined, invalid, or otherwise unacceptable, the Company may suspend, delay, or cancel the relevant Order.

Settlement of Orders

Following Pricing Time:

The Company operates on a strictly non-custodial basis and does not hold or control client funds or Digital Assets.

Settlement timeframes depend on third-party systems, including banking infrastructure and blockchain networks. Delays outside the Company’s control may occur, and the Company shall not be responsible for such delays.

Accuracy of Instructions and Irreversibility

You are solely responsible for ensuring the accuracy and completeness of all information provided in connection with an Order, including:

You confirm that:

Transactions involving Digital Assets are irreversible. Once executed:

The Company does not verify the accuracy of wallet addresses or other transaction details and shall not be liable for losses arising from errors in such information.

Risk Acceptance

Prior to placing an order, clients must expressly acknowledge and accept the risks associated with the Services by actively confirming acceptance of the Company’s Risk Disclosure by electronic means before an order is submitted.

Note on Compliance Controls

Prior to executing a client order, the Company reserves the right to request documentation establishing the legal basis for, and the source or origin of, the funds and/or crypto-assets involved, as well as any other KYC information it deems necessary. Failure to provide such information entitles the Company to decline or suspend the order until the required information is duly provided.

The Company may further require the client to submit documentation confirming the legal basis for the acquisition of funds or other assets, including information regarding the source or origin of funds or crypto-assets, and any other documents or information necessary to fulfil the Company’s obligations under applicable anti-money laundering, terrorist financing prevention, and other relevant legislation.

The Company reserves the right to refuse to provide its Services, suspend the fulfilment of an order, or terminate its relationship with a client where the client fails to submit required documentation, avoids or declines to provide necessary information, withholds documentation, or provides information that is inaccurate or incomplete.

Bitsbazar may reject or suspend an order where: identity cannot be verified; same-name checks are not satisfied; the risk profile of the transaction is elevated; the origin of funds is unclear; or a legal or regulatory obligation requires suspension.

The Company may suspend or terminate the execution of a client order where required to do so by applicable Canadian legislation or other binding legal obligations.

Where the Company has reasonable grounds to doubt that an order was submitted by the client, or where other legal or substantive concerns arise in relation to a submitted order, the Company may request additional information and/or decline to execute the order.

Where information provided in an order is insufficient or otherwise irregular, the Company may, depending on the nature of the irregularity, either reject the order or execute it on the basis of the information as submitted.
